Hi all -
The county is seeking comment on its new Administrative regulations. See
link below. I haven't reviewed the document yet, so I can't offer any
preamble. As I understand it, the primary objective is to create some
consistency among the various Part 1 districts in the county, which is
sensible.
The county has already approved several procedural improvements to our
zoning, as part of our settlement of the Petty case (a zoning appeal from
2014).
The recent amendments also revoked section 14.2, which consolidated small
parcels in common ownership, as of creation of the district in 1971. One
could argue the merits of this move, but it has the unseemly appearance of
relieving the county of liability for issuing land use permits on a parcel
with a contested pedigree, that is the subject of a current complaint to
which BCPOA is a party.

The County Attorney's Office, Compliance Office, and Planning Department
have collaborated to produce draft Gallatin County "Part 1" Zoning
Administrative Regulations and are looking forward to your comments.
Currently the variability in review processes, criteria, authority, and
other administrative provisions within Gallatin County's 15 "Part 1" zoning
districts causes confusion for the public and increases the likelihood of
procedural problems. The Administrative Regulations are intended to address
such concerns by adoption of a single administrative regulation for the
County's 15 "Part 1" zoning districts. We are asking interested parties to
review the draft Administrative Regulations and submit their individual
comments via email to <mailto:sean.ocallaghan at gallatin.mt.gov>
